Terms of Use

1. Acceptance of Terms

By downloading, installing, or using VivyShot ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Product Scope

VivyShot is an open source screenshot capture, annotation, and recording product for macOS.

3. Licensing

Source code published at https://github.com/vivy-company/vivyshot is distributed under the published repository license terms.

  • The macOS app sources are licensed under GPL-3.0-only.
  • Official App Store binaries use Apple’s App Store terms together with VivyShot binary terms.

4. Restrictions

  • You may not use the App for unlawful purposes.
  • You may not remove or alter proprietary notices in official binaries.
  • You may not misrepresent modified builds as official VivyShot releases.

5. Captured Content

You are responsible for the content you capture, annotate, export, and share through VivyShot, including ensuring you have permission to capture or distribute that material.

6. App Store Distribution

Official macOS distribution is available through Apple’s App Store. The current pricing is a free base app, a $9.99 one-time Lifetime unlock for capture transitions, microphone audio export, webcam and keystroke overlay export, GIF export, capture statistics, HEVC, 60 fps, and high-bitrate exports, and an optional $24.99 Supporter purchase that includes Lifetime plus an in-app supporter badge and extra support for independent development. If the App is obtained through Apple, billing, refunds, and account management are handled by Apple.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR EVERY WORKFLOW.

8. Limitation of Liability

IN NO EVENT SHALL VIVY TECHNOLOGIES CO., LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP OR WEBSITE.

9. Governing Law

These terms shall be governed by the laws of Hong Kong SAR, without regard to its conflict of law provisions.
